A woman sued her employer after she was fired following several complaints about smoking in her workplace. Despite a lack of criticism of her work performance at any time prior to her termination, the employer told Carberry she was being fired because she had a “bad attitude.” Carberry is seeking reinstatement in a smoke-free area and an award of damages.
