Concepcion v. City of New York

A nonsmoking worker for New York City’s Department of Homeless Services filed suit, claiming that her exposure to tobacco smoke at her workplace exacerbated her asthma.  The Plaintiff brought claims under the Americans With Disabilities Act and the Federal Rehabilitation Act.  In December 1997, the parties reached a final settlement whereby the city agreed to pay Delia Concepcion $140,000 and to transfer her to a different building.
