Bloom filed suit against his former employer, alleging that the Defendant discriminated against him in violation of the ADA as well as state and local law when it failed to provide him a reasonable accommodation for his disability (asthma), constructively discharged him and created a hostile work environment because of his disability. The defendant moved for summary judgment, arguing that it was not aware that he has asthma. Bloom argues that he had given the company over 20 memoranda stating that its violation of the New York Clean Indoor Air Act caused him to suffer breathing difficulties.
