Levoy v. Levoy

On December 8, 1993, a nonsmoking father and smoking mother agreed on a provision in a marital separation agreement that the “Parties agree not to smoke in the same room as the minor child, and they will use their best efforts to discourage third parties from smoking in the child’s presence.  The parties understand that ‘the same room’ includes a motor vehicle.”

Docket No. 90D 832-AL (Norfolk County (MA) Division of Probate & Family Court, 1993).
