An office worker, alleging that he suffered from respiratory and cardiovascular ailments, unsuccessfully sued the State of Oklahoma, claiming that it had violated his First, Fifth, Ninth and Fourteenth Amendment rights by failing to prohibit smoking in the area where he worked at the Oklahoma Department of Human Services.
