In re: United Telephone Company of Florida and International Brotherhood of Electrical Workers, Local 199

An employer designated a certain table in the employees’ cafeteria as no-smoking based on a building supervisor’s study of a ventilation plan for the cafeteria.  An arbitrator ruled that “the Company’s establishing the first table as a no smoking table serves a legitimate business purpose, that is, providing a healthy work environment and reducing potential expenses related to possible passive smoking caused sickness.”
