Evans v. Schriro

An inmate claimed that he was unconstitutionally exposed to environmental tobacco smoke (ETS) and that a case worker retaliated against him by threatening to send him to segregation if he did not stop filing complaints about ETS..  After district court granted summary judgment for the defendants, the inmate appealed.  The U.S. Court of Appeals for the Eighth Circuit affirmed summary judgment of the ETS claim but reversed the dismissal of the retaliation claim.
