A nonsmoking cashier at a butcher shop sued after he was fired after he had complained that workers were smoking there in violation of a Florida statute (Florida Clean Indoor Air Act, which makes it illegal, as of July 1, 2003, for workers at indoor businesses to smoke on the job) and reported the violations to the Florida Department of Health. The company claims that Davis was fired because of poor job performance and not for having been a “whistleblower,” which Davis asserts is the true reason he was fired.
