Bourbeau v. City of Chicopee, et al.

A former assistant supervisor sued the City of Chicopee and a superintendent for intentional infliction of emotional distress, a hostile work environment, and physical injuries, alleging that he had been harassed for complaining about smoking coworkers in the garage where he worked.  He alleged that, although smoking was banned in indoor buildings, the supervisor failed to take action or address the situation.  The Plaintiff also claimed that he suffers from coughing, loss of sleep, and aggravated seizures.  The city denied wrongdoing or liability.  The case was settled in January 2007 for $85,000.
